Ok Tedi Mining Ltd has been subject to four legal actions, two in the Supreme Court of Victoria, Australia, and two constitutional references in the Supreme Court of PNG by two plaintiffs. Of the two Victorian Supreme Court actions, one, a damages claim, was dismissed on 18 December 2003, and the other, a class action, was dismissed on 18 January 2004. The PNG constitutional references were also dismissed on 18 January. OTML, the PNG Government and villagers from more than 150 villages in the Western Province, have signed Community Mine Continuation Agreements (CMCAs) as a means of OTML providing funds for development programs and initiatives for the people affected by the mine's operations. The villagers who were party to the legal action were not signatories to the CMCAs. Those remaining villagers who chose not to sign CMCAs are being invited by OTML and the PNG Government to become part to the CMCAs' benefits. A previous damages action brought by landowners against OTML and BHP was settled out of court in 1996. More details on the dismissal of the legal actions can be found at News & Reports. |
